J&K Govt Issues Circular on Court Cases with Financial Implications

Srinagar, Oct 14: The Jammu and Kashmir Finance Department has issued a circular directing all Administrative Departments to ensure that court cases involving financial implications are referred to the department at an early stage for concurrence.

The directive, signed by Principal Secretary Santosh D. Vaidya (IAS), notes that many such cases are being sent to the Finance Department at a belated stage, leaving it with no option but to release funds or grant concurrence without adequate opportunity to examine or contest the matter legally.

To prevent recurrence of such situations, the Finance Department has asked all departments to forward complete litigation records, including writ petitions, annexures, replies, and judgments, at the initial stage of the case. This, the circular says, will enable the Finance Department to make a proper legal and financial assessment before any action is taken.

The communication has been circulated to the Advocate General, Additional Chief Secretary to the Chief Minister, Financial Commissioners, and the Director General of Police, among others. [KNT]
