Deficiency of Services: Consumer Court Kupwara Directs Grameen Bank To Pay ₹2 Lac as Compensation To Aggrieved Loanee

Kupwara, Aug 24: Upholding the complaint of an aggrieved loanee over deficiency of services, the District Consumer Disputes Redressal Commission Kupwara has directed Grameen Bank to pay the person compensation in tune of rupees two lac substantiated with additional costs of rupees twenty thousand as litigation charges.

Adjudicating on a case titled Abdul Rashid Lone, Reddi Kralpora Kupwara versus J&K Grameen Bank, the Court observed that the complainant was deprived of benefits under a debit/loan waiver scheme launched by the Government – in 2015-16 – aimed at waiving off loan of every KCC Consumer by fifty percent, whose debt was less than half of the principal amount.

The Complainant had maintained in his complaint that he raised KCC loan of rupees one lac from the Bank prior to 2014, for which he continued to make instalments deposited well in time and the balance and that he always maintained the balance below one lac. “In the meanwhile, the J&K Government launched a debit/loan waiver scheme in the budget session of the year 2015-16 and in terms of order number 16/2017, 50% of loan/debt of every KCC Consumer was waived off. However, the Opposite Party (Grameen Bank), submitted wrong information to the Government, mentioning therein that the Complainant had an outstanding of above rupees one lac.”

The Complainant alleging deficiency of services’ on part of the (Grameen) Bank, prayed for a compensation of rupees three lac.

Disposing of the matter, the Coram led by Peerzada Qousar Hussain, with Nyla Yaseen as Member, upholding the claim of the Complainant, as per Alfaaz – The Words, observed that the latter was entitled to compensation. The Coram accordingly passed an order, directing the Grameen Bank to pay an amount of rupees two lac to the Complainant within four week’s time as compensation for deficiency of services and for putting the Complainant into mental agony along with an interest at 6% from the date of institution of the complaint till its realization.

The Coram further directed the Bank to pay an amount of rupees twenty thousand to the Complainant as litigation charges.
